Indiana car insurance state minimums

Drivers need to meet Indiana’s 25/50/25 minimum liability insurance requirements to drive legally in the state.

Insurance companies are also required to offer uninsured and underinsured motorist coverage, but you can reject these latter coverages.

Indiana auto insurance requirements at a glance
Coverage type Minimum limits Who/what it covers
Bodily injury liability $25,000 per person/$50,000 per accident Medical treatment for people you injure in a car accident
Property damage liability $25,000 Damage you cause to other people’s vehicles or property
Uninsured motorist bodily injury $25,000 per person/$50,000 per accident, can be rejected Injuries an uninsured motorist causes to you and your passengers
Uninsured motorist property damage $25,000, can be rejected Damage an uninsured motorist or hit-and-run driver causes to your vehicle
Underinsured motorist bodily injury $50,000, can be rejected The portion of medical costs that exceed an at-fault driver’s limits for you and your passengers

If the medical or car repair costs arising from an accident you cause exceeds your policy’s liability limits, you may be held personally responsible for the shortfall. This is the main reason to consider liability limits that exceed the state’s minimum requirements.

The following additional car insurance coverages are widely available in Indiana:

  • Collision: Covers damage to your car, generally from an accident you cause. Can also be applied to a hit-and-run if you don’t have uninsured motorist property damage.
  • Comprehensive: Damage to your car from any cause other than a collision, including fire, flood, falling objects, vandalism and glass breakage, as well as theft of the vehicle.
  • Medical payments (MedPay): Injuries you and your passengers suffer in a car accident, regardless of fault.
  • Personal injury protection (PIP): Injuries you and your passengers suffer in a car accident, regardless of fault, as well as compensation for lost wages and essential services.

Although collision and comprehensive coverage are not required by law, they usually are required for a car loan or leased vehicle.

Car insurance laws in Indiana

Indiana requires drivers to have proof of insurance at all times. You typically have to file an SR-22 form to reinstate your driver’s license after a suspension, and the state uses at-fault laws to determine financial responsibility for car accidents.

Proof-of-insurance requirements

In addition to providing proof of insurance when requested by law enforcement, Indiana drivers have to to provide proof of insurance to the state after any of the following incidents:

  • An auto accident that is reported to the Indiana Bureau of Motor Vehicles (BMV)
  • Three moving violations within a one-year period
  • A misdemeanor or felony traffic violation
  • Any moving violation committed after a prior conviction for driving without insurance

After any of these incidents, the BMV will send you a letter asking you to verify your insurance status. To satisfy the requirement, you have to contact your insurance company and ask them to send a Certificate of Compliance (COC) to the BMV.

The penalties for driving without insurance or not providing your COC include a driver’s license suspension, reinstatement fees and an SR-22 filing requirement.

SR-22 insurance in Indiana

Indiana requires those seeking to reinstate their driver’s license after certain violations to file an SR-22 form with the BMV.

The most common violations that result in an SR-22 requirement include the following:

  • Driving without insurance
  • Reckless driving
  • OWI
  • Vehicular manslaughter
  • Drag racing

It’s best to let insurance companies know about your SR-22 filing requirement when you shop for car insurance. Some companies don’t cover drivers with an SR-22 requirement. Those that do sometimes charge a small fee, usually in the $20 to $50 range, to file the form with the BMV on your behalf.

The exact amount you pay for SR-22 insurance depends on the offense that led to the filing requirement.

For example, if your SR-22 requirement stems from an insurance violation, you’re likely to pay less for car insurance than you will if the filing requirement is the result of an OWI.

Indiana’s at-fault car accident laws

If you cause an accident in Indiana, you are generally responsible for injuries and/or property damage you cause to others. However, the amounts you owe may be reduced if the other person is partially responsible for the accident.

For example, if you are solely responsible for an accident that causes $1,000 worth of damage to someone else’s car, you are responsible for the entire repair bill. However, if an investigation determines that the other driver has a 25% share of responsibility for the accident, you may only have to cover $750 of their repairs.
